Terms of Service

SMS consent

Before you ask us to send a text message to a customer, you must have their permission to text them for this purpose. You confirm that permission yourself, on each text message request. We do not verify it, and we are not responsible for confirming it: that responsibility is yours. If a customer complains that they did not agree to be texted, we may ask you for details of how consent was given, and we may suspend the ability to send text messages, or your account, while we look into it.

Acceptable use

Alemarde is for asking your own customers, one at a time, for a review after real work you did for them. Do not use it to send unsolicited messages, import bulk contact lists without each person's consent, or send anything other than a review request. Sending what a phone carrier, email provider or customer reports as spam is a breach of these terms, and we may suspend or close your account for it.

Customer data

When you use Alemarde, you are the controller of your customers' personal data (names, contact details, service dates, feedback). Alemarde acts only as a processor, handling that data on your instructions to send review requests and display results to you. You are responsible for having a lawful basis to contact your customers and for honoring their data rights. We handle the data as described in our Privacy Policy.

Pricing and payment

Alemarde offers a free plan and paid plans. Current prices are listed on the pricing page. Paid plans are billed monthly through Paddle, our payment processor. By subscribing to a paid plan, you also agree to Paddle's terms. You can cancel anytime; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months, except where required by law.

Intellectual property

Alemarde and its underlying software are owned by us. You retain all rights to the content you upload (customer lists, message templates, review links). You grant us a limited license to use that content only to operate the service for you.

Changes to the service

We may add, change, or remove features of Alemarde at any time. We will give reasonable notice of significant changes that affect your use of the service.

Termination

You may stop using Alemarde and close your account at any time. We may suspend or close your account if you breach these terms, in particular the consent and acceptable-use sections above. Where we can, we will tell you why before or when we do this.

Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email or through the service at least 14 days before the changes take effect. Continued use of Alemarde after that date means you accept the updated terms.

Liability

Alemarde is provided as-is. We work to keep it available and accurate, but we don't guarantee it will be uninterrupted or error-free, or that sending a review request will result in a review. To the extent the law allows, our liability to you for any claim arising from your use of Alemarde is limited to the amount you paid us in the 12 months before the claim — or, if you're on a free plan, to €10. We are not liable for indirect or consequential losses, such as lost profits or lost customers.

Governing law

These terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules. Any dispute arising from these terms will be resolved in the courts of that jurisdiction, except where local consumer-protection law gives you the right to bring it elsewhere.
